1. Intellectual Property
All original artwork, images, designs, and content on this website are protected under Canadian copyright law and remain the exclusive property of Jamie McFarlane.
Purchase of artwork does not transfer copyright.
Artwork may not be reproduced, altered, distributed, or used commercially without written permission.
Some artwork displayed and labeled is for show of skill not commercial sale.
2. Purchases & Payment
Prices are listed in CAD unless otherwise stated.
Payment is required in full at checkout.
We reserve the right to cancel or refuse orders due to errors, availability, or suspected fraud.
3. Shipping
Shipping times are estimates only.
We are not responsible for delays caused by carriers, customs, or circumstances beyond our control.
Customers are responsible for providing accurate shipping information.
4. Returns & Refunds
Returns are governed by our Refund Policy, which forms part of these Terms.

5. Commissions
Commissioned artwork is final sale once the painting is accepted by the client.
Copyright remains with the artist unless otherwise agreed in writing.
Minor revisions may be allowed prior to final approval at the artist’s discretion.
6. Limitation of Liability
To the fullest extent permitted by Canadian law, Jemartwork.ca/Jamie McFarlane shall not be liable for indirect or consequential damages arising from the use of this website or purchased artwork.
7. Governing Law
These Terms are governed by the laws of Saskatchewan, Canada and applicable federal laws of Canada.
